Final Rules: Manufacturing Texas Consumable Hemp Products

The Texas Department of State Health Services (DSHS) has released the final rules that will govern the manufacture of consumable hemp products in Texas. These rules will go into effect on August 2, 2020. The biggest thing to note is that the rules explicitly prohibits the manufacture, processing, distribution, or retail sale of consumable hemp products for smoking. 1690 commenters contacted DSHS to opposed this prohibition. The reasons commenters gave for opposition to the prohibition of the retail sale of smokable hemp products contained included: A deleterious effect on the overall Consumable Hemp Product business in Texas, particularly on those businesses already selling the products. Texas Consumable Hemp Product Rules Open for Formal Comment

The Texas Department of State Health Services (DSHS) has released the newest iteration of their proposed rules for consumable hemp products. They are asking for formal comments on these rules be submitted by the 6/8/20 deadline. It is expected that final rules will take effect in July with the earliest possible date of adoption being early June. We suggest that you read the proposed rules. Texas Farmers Can Apply to Grow Hemp Starting Monday!

Starting tomorrow, farmers will be able to submit applications to grow hemp to the Texas Department of Agriculture (TDA). The applications are available online or at the five regional offices. TDA Commissioner Sid Miller posted a video about what to expect for the application process. The Agriculture Committees in both the Texas House and Texas Senate plan to hold interim charges regarding the rollout of the Texas Hemp Program. However, the Texas Legislature recently said, “In light of recent concern for the public’s health due to the CoronaVirus and to ensure the greatest amount of participation in policy issues to be studied by the Committee this interim, these charges will be taken up at a later date.” Stay tuned for more information.
