Opportunity for Regulatory Feedback: Compassionate-Use Institutional Review Board

Earlier this year the Texas Legislature passed HB 1535 to improve the Texas Compassionate Use Program (T.CUP) during the regular session. This legislation included a provision to create “Compassionate-Use Institutional Review Boards” (CIRB) which could potentially add new qualifying conditions, facilitate research, and track the impact of medical cannabis on patients participating in the program. The Department of State Health Services (DSHS) has been tasked with the creation of the CIRB regulatory framework.  DSHS has released their first iteration of the CIRB regulations, which can be reviewed here. This legislation added conditions and modified cannabis THC potency levels. These changes took effect as of September 1, 2021.
